YourGiftsy Copyright Dispute Policy

In accordance with the Digital Millennium Copyright Act (DMCA), YourGiftsy has adopted the policy below regarding copyright infringement.

We reserve the right to:

  1. Remove or block access to any material that we believe in good faith is copyrighted content that has been copied or distributed unlawfully by advertisers, affiliates, content providers, members, or users; and

  2. Suspend or terminate access to our services for repeat infringers.

Your use of YourGiftsy services is always subject to our Terms of Use, which incorporate this DMCA Policy.


Procedure for Reporting Copyright Infringements

If you believe that material available on or through YourGiftsy infringes your copyright (or the copyright of someone you represent), please send a DMCA Notice of Copyright Infringement to our Designated Agent with the following details:

  1. Signature – A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

  2. Identification of Work – A description of the copyrighted work claimed to have been infringed.

  3. Identification of Infringing Material – Details about the allegedly infringing material, including its location on the YourGiftsy website, with enough information for us to locate it.

  4. Contact Information – Name, address, telephone number, and email address of the complaining party.

  5. Good Faith Statement – A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

  6. Accuracy & Authority Statement – A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.


What Happens After We Receive a Valid Notice

Upon receipt of a valid DMCA notice, YourGiftsy may:

  • Remove or disable access to the infringing material.

  • Notify the user or content provider accused of infringement.

  • Terminate access to repeat infringers in accordance with our policies.


Counter-Notice Procedure

If you are the content provider and believe that the removed or disabled material was taken down due to mistake or misidentification, you may submit a Counter-Notice to our Designated Agent including:

  1. Signature – Your physical or electronic signature.

  2. Identification of Removed Material – The material removed or disabled and its location before removal.

  3. Good Faith Statement – A statement that you believe in good faith that the material was removed or disabled as a result of error or misidentification.

  4. Contact Information & Consent – Your name, address, phone number, email address, and a statement that you consent to the jurisdiction of the Federal Court for your judicial district (or, if outside the U.S., the jurisdiction where YourGiftsy is located). You must also agree to accept service of process from the party who filed the original infringement claim.


Restoration of Content

If YourGiftsy receives a valid Counter-Notice, we may forward it to the original complainant. Unless the copyright owner files a legal action seeking a court order against the content provider, the removed material may be restored or access reinstated within 10–14 business days after receipt of the Counter-Notice, at YourGiftsy’s discretion.
